      Hi, i recived my conditional green card 3 months ago.it expires 2018.I got abused by my husband police took him to the Jail and they gave me Tpo protection order.I want to get divorce him.But since marriage is less than 2 years I dont know how is it gonna effect my Legal status in the future.What are my options now ?

      We are sorry to hear that.

      Please note, you may be eligible to file for USCIS I-751 for removal of conditions prior to the normal 2 years conditional window.

      Here’s an excerpt from the USCIS’ Remove Conditions on Permanent Residence Based on Marriage page:

      “If You Are No Longer Married To Your Spouse or If You Have Been Battered or Abused by Your U.S.-Citizen or Lawful Permanent-Resident Spouse or Parent

      You can apply to waive the joint filing requirement if you are no longer married to your spouse, or if you have been battered or abused by your U.S.-citizen or lawful permanent-resident spouse or parent.

      In such cases, you may apply to remove the conditions on your permanent residence at any time after you become a conditional resident, but before you are removed from the country. You must provide evidence that removal from the United States would cause you extreme hardship.”

      We highly recommend you talk to an immigration attorney so they can best guide you how to proceed next.

      Do you mean I still have to wait 2 years to file I-751? Or I can do it now?

      Per USCIS’ instructions you do not need to wait for the 2 years; you can file it now.

      I cant afford a lawyer currently 🙁 And there is not much information what to do in my situation..
